摘 要:中国用益物权制度移植德国物权体系,基本反映不动产的财产利用关系,但缺乏对公有制和现代财产利用关系的有效规制。中国物权立法应当在公有制框架下寻求制度的构建,实现公有制财产利用关系与用益物权的衔接,应利用制定中国民法典之机,规定国家财产权制度,确认各类国有资产使用权的用益物权类型。The Chinese usufructuary right system, a transplantation from Germany property right system, basically reflects the using relations of real estate property. However, it lacks the effective regulation for using relations between public ownership and modern property. The constitutional government system of public ownership has a profound impact on Chinese politics and economics. Real right legislation of China should seek system building under the framework of public ownership, so as to realize the linkage between the using relations of public ownership property and the usufructuary right. And we should take advantage of formulating Chinese civil code to provide the national property rights system, and confirm the types of usufructuary right in the using right of all kinds of state - owned assets.
