摘　　要：随着大数据技术的广泛使用,数据的价值与日俱增,其中个人数据是具有较高价值的一类数据。因为缺乏合法的交易渠道,个人数据的非法交易也日益猖獗。为了打击非法数据交易所形成的产业链,应扩大刑法的打击范围,将非法数据交易的协助者也纳入处罚范围。对于购买非法个人数据的主体也应给予行政处罚。另外,为了引导个人数据交易的有序进行,应在明确个人数据人身属性与财产属性的基础上,设立专门的数据交易中心,以满足各方对数据的需求。With the usage of big data technology, the value of data reviled rapidly, and personal data is one of the most valu- able data. The illegal personal data transaction thrives for the lack of legal transaction platform. For punishing the chain of illegal data transaction, it is necessary to expand the scope of criminal law and the illegal data transactions are also included in the scope of punishment. The administrative punishment is proposed for the buyers of illegal data transaction. Moreover, in order to legalize the personal data transaction, data transaction platform should be set up based on the clarity of attribution of personal data.
