环境行业标准在环境法律责任中的功能

摘　　要：关于"排污符合国家或者地方污染物排放标准"是否要承担民事侵权责任的问题学界一直存在争议。而据此忽视环境行业标准在环境侵权责任乃至整个环境法律责任中的功能是不可取的。环境行业标准的技术属性是讨论环境法律责任的基础,环境行业标准的法律属性是讨论环境法律责任的重心。环境行业标准在环境行政责任和环境侵权责任中的规范、证据展示和价值指引功能意义值得深入探讨。The controversial issue of whether or not the polluters should bear tort liability for discharge of pol- lutants in conformity with the state or local standards exists in the academic field. However, it is not desirable to ignore the function of environmental industry standard in environmental tort liability and the whole environmental legal liability. The technical attribute of environmental industry standard is the basis of discussion on environmental liability and the legal attribute of environmental industry standard is the focus of discussion on environmental liability. It＇s worthwhile to study the specification, evidence discovery and value guidance of the environmental industry standard in the environmental administrative liability and the environmental tort liability. We need to study seriously the environmental industry standard and its function and significance in the legal system.
