一起小麦联合作业机械播种质量纠纷的农业司法鉴定案例分析

摘　　要：通过书面证据审查、现场勘验和实验室测定等方法,认定因小麦联合作业机械播种质量未达标是造成小麦严重缺苗的主要原因,与涉诉小麦经济损失间具有因果关系。鉴定组采用相邻对照法估算了涉诉小麦的经济损失。经法院质证审查采信了鉴定意见,为法院公正审理案件提供了法定证据和科学的司法证明。Through the written evidence review,on-site inspection and laboratory determination method,it was found that the main reason for the serious lack of wheat seedling was caused by the mechanical sowing quality,which had a cause and effect relationship with the economic loss of wheat.The economic losses of wheat were estimated by adjacent control method.The Court adopted the expert opinion after a cross examination,providing legal evidence and scientific judicial proof for the fair trial of the Court.
