摘　　要：北京市档案馆藏有大量民国时期北平地方法院的婚姻诉讼类档案,其中,下层女性以不堪受虐为由诉请离婚的案件较多。对这些案件进行整理分析,不仅有助于深化对案件本身的认识,亦有助于从中透视涉讼女性的婚姻生活、婚姻观念及其与社会变迁的关系。在20世纪40年代初的北京社会,这类讼离案的增加虽然在一定程度上反映出涉讼女性的个体意识的觉醒,但案件背后的经济原因也值得重视。尽管她们通常都化身为诉状中楚楚可怜的受虐女子,但其诉请离婚的真实原因却未必是受虐待,也可能是迫于生计另谋出路。Beijing Municipal Archives collects a large number of marriage lawsuit archives of Beiping District Court of period of the Republic of China,especially of those who could not bear to be abused but suing for divorce in lower society.Analysis on these cases can not only help us to deepen the understanding of these cases themselves, but also help us to understand these women's marriage,idea and the relations between the marriage condition and the social change. At the beginning of the 1940 s,in Beijing,while the increase of the number of marriage lawsuits by those women who could not bear being abused by their husbands to some extent reflects that the women's individual consciousness had been awakened,however,the reason in the economic aspect behind the cases should also be emphasized. Although those women often looked like very poor because of being abused by their husbands,but the real reason for their divorce was not necessarily abused,it also might be a tragedy to make a living.
