摘　　要：市场规范化程度的提高,客观上给产品标准化提出了越来越高的要求。在标准化推广中,越来越多的专利技术被纳入技术标准。其中存在的问题是,部分专利权人利用技术标准化的优势,实施了劫持行为,如向技术标准的使用者索要高额的许可使用费、拒绝许可、以禁令威胁等。此行为如何界定,其特点如何,如何借鉴国外法律规制的经验,我国应如何界定并加以规制,都需要进行认真研究。The elevation of market standardization places higher requirement for product standardization. While promoting standardization, more and more patent technologies have been incorporated into technological standards. The problem is that some patentees carry out patent hijacking activities, taking advantage of technological standardization. These activities include demanding exceedingly high royalty feed from technological standard users, refusal of license, posing treat with injunctions, etc. How to defi ne the activities, the characteristics, and how to borrow from foreign legal experiences to enrich China＇s laws and regulations in this regard call for serious studies.
