摘　　要：政府购买公共服务是对公共管理理念与模式的创新,其实质是公共服务合同外包。本文通过剖析政府购买公共服务的法律关系构成,指出了现阶段我国政府购买公共服务存在的主要问题,据此提出双阶段竞争的购买模式思路。同时,以法律逻辑为切入点,探究了政府购买公共服务的法律规制路径,以期推进政府购买公共服务的市场化、规范化、制度化。Governments purchasing public services is an innovation for the public management＇s idea and mode,which in essence is public services contract outsourcing.The paper,through analyzing the legal relationship constitution of governments purchasing public services,points out that main problems exist in our country＇s governments purchasing public services at the present stage,and hereby puts forward the double-stage competition purchasing mode thought.Meantime,taking the legal logic as entry point,the paper explores the legal regulation path of governments purchasing public services in order to promote market orientation,standardization as well as system orientation of governments purchasing public services.
