试论集群犯罪的条件控制

摘　　要：集群犯罪与集群行为或群体性事件既有联系又有区别,并非等同。虽然集群行为中包含着集群犯罪形态,合法集群行为亦具有很大的潜在危险性,常常因为失控而转化为集群犯罪,但这仅仅是一种可能性而非必然性。集群犯罪的发生不是简单的感应式因果关系,在集群犯罪的因果链条上,还有一个重要变量因素——犯罪条件。从某种意义上说,控制了犯罪条件,犯罪结果就不会发生。在当前社会冲突加剧、集群犯罪的成因难以短期根除的背景下,将防控集群犯罪的视角由犯罪原因转向犯罪条件,从"群体情绪"、谣言传播、"重点人物"、"受害人"、突发因素以及"处置因素"等这些关键条件因素入手,打破集群犯罪的结构,阻断集群犯罪的成因与犯罪结果之间的联系,对于控制集群行为的恶性转化、遏制集群犯罪的发生和维护社会稳定等无疑具有重要的现实意义。There are relations and differences between a colony crime, a collective behavior and a group incident. Although collective behaviors contain the form of colony crimes and legal collective behaviors also have huge potential risks to be transformed into colony crimes without control, yet it is only possible instead of inevitable. The emergence of colony crimes ia not a simple inductive causality. There is an important variable factor, the crime condition, in the causal chain of colony crimes. In some sense, the criminal consequence would not occur as long as crime conditions have been controlled.Under the background of intensifying social conflicts and irrevocable reasons of colony crime in a short time, it has undoubted important practical significance for controlling vicious transformation of collective behaviors, containing the emergence of colony crimes and safeguarding the social stability that we turn our perspective of colony crime prevention and control from criminal causes to crime conditions, start with some key elements such as ＂the group emotion＂, ＂the rumor spread＂, ＂the key figure＂, ＂the victim＂, the unexpected factor and ＂the disposal factor＂, break the structure of colony crimes and block the connection between reasons and results of colony crimes.
