摘　　要：罗克辛教授将刑事政策置入刑法体系内,解决了刑法体系与刑法教义学、社会发展与立法相对滞后的矛盾,这对我国构建刑法体系具有重大的借鉴意义。将少数民族刑事政策置于刑法体系内,在构成要件符合性、违法性和罪责中融入刑事政策,形成目的理性的犯罪论体系,能解决个案正义与刑法体系稳定性的冲突,兼顾刑法体系逻辑性与刑事政策价值性双重优点,防止刑法体系僵硬化之危险,发挥少数民族刑事政策灵活性之优势。The placement of criminal policy in criminal system by Professor Roxin has resolved the contradiction between the system of criminal law and criminal dogmatics,as well as the contradictions between social development and legislation lags,which is of great significance to the building of criminal law system in China.Blending ethnic criminal policy in the criminal system,constitutive requirements,illegality and responsibility in the integration of criminal policy and forming rational purpose of crime theory system,can solve the conflict between individual justice and criminal law system stability.Taking into account the criminal law logic system and criminal policy value of dual advantages,the policy would prevent the danger of the rigid criminal law system,and have the advantage of the flexibility of the criminal policy of ethnic groups.
