摘　　要：从新中国成立以来中央政法委在三个历史时期演变历程看,其职能化现象呈现出不断强化的趋势,其核心线索是政法工作中如何处理好党政关系问题,实质是在坚持党领导政法工作的前提下,如何保证司法机关独立性的问题。只有正确处理"坚持党的领导与保证司法独立""维权与维稳"以及"扩权与维稳"这三组关系,才能解决中央政法委面临的"职能化异化"的突出问题。The 4th plenary session of 18 th central committee of CPC put forward the great deployment of comprehensively promoting the rule of law,which has been included into strategy blueprint of ' Four Comprehensives'. Judicial reform has become a priority of comprehensively deepening reform for some time. The Central Commission of Political and Law( CCPL),as a functional department of the Central Committee of CPC,is totally engaged in the leadership and management of political and legal affairs.In the context of comprehensively promoting the rule of law,how to deal with the relationship between the Party and the government is the core issue for the CCPL to advance with the times. Meanwhile,this core issue is expressed in specific as the difficult trouble of the ' alienation of functionalization' faced by the CCPL. By reviewing its evolution from three historical periods after1949,the key point to solve the trouble of the ' alienation of functionalization' depends on how to deal with the relationship between the Party's leadership and judicial independence,rights protection and maintaining the social stability,and t the power of the CCPL expansion and maintaining the social stability.
