《国家教育考试违规处理办法》溯及力问题探析——以高等教育自学考试违规处理为例

摘　　要：《国家教育考试违规处理办法》的修改涉及到法律中的溯及力问题。结合刑法的研究成果,国家可以根据"33号令"终止已经执行的处理决定。建议对涉及此问题的高等教育自学考试违规考生适用溯及,使其能够相对提前地继续参加高等教育自学考试或毕业。The change of ＂National education examination irregularities processing method ＂ involves of the retrospective effect problem in law.Analyzing the cause from two aspects of the retrospective effect in ＂33 order＂,Combined with the results of criminal law research,we may stop the execution of decision according to ＂33 order＂.Higher education self-taught examination students mayapply retroactivity,and to make them able to continue to attend it or graduate relatively earlier.
