摘　　要：直至晚近以来的国际投资协定仍然重视和强化对投资者利益的保护。经济全球化的发展和可持续发展理念的兴起,使国际投资协定越来越关注国际投资在经济价值之外的环保、人权、公共健康等领域的公共利益和社会价值。在变化的条件下,我国须摒弃简单的身份立场判断,对每个国际投资协定的谈判和签署进行细致的权利义务考量。Until recently, the international investment treaties valued the interests of investors. But withthe trend of economic globalization and sustainable development, the international investment treaties havebeen increasingly concerned with the public interest and social values, including environmental protection,human rights and public health. Under such circumstances, China should not persist in the simple stand onthe basis of identity verification. Rather, we need think carefully about the rights and obligations in negotiating and signing every international treaty.
