论中国特色社会主义法治道路的特色

摘　　要：中国特色社会主义法治道路的特色主要体现在发展轨迹、治国方略、根本保证、制度基础、学理支撑、人权保障、发展动力、法域类型等八个方面。其中,发展轨迹、治国方略两个方面的特色,突出体现了法治道路与传统文化的紧密性;根本保证、制度基础、学理支撑、人权保障四个方面的特色,突出体现了中国特色社会主义法治道路的姓"社"性;发展动力方面的特色,突出体现了中国特色社会主义法治道路的过渡性;法域类型方面的特色,突出体现了中国法治道路的包容性。The features of the road of socialist of law with Chinese characteristics have eight aspects.That is,development track,strategy of running a state,scientific principle or law,basic guarantee,restriction of powers,protection of human rights,motive force of development and scope of law.Among these above aspects,the development track and strategy of running a state show the affinity between the road of socialist of law with Chinese characteristic and Chinese traditional culture.Not only this,the following four aspects which include scientific principle or law,basic guarantee,restriction of powers and protection of human rights show the named socialism about the characteristics of the road of socialist rule of law with Chinese characteristics.The motive force of development show the transitivity of the feature of the road of socialist of law with Chinese characteristics.At the same time,the scopes of law show the inclusive feature.
