摘  要:我国当前积极实施页岩气产业政策,但实践中页岩气勘探开发工作进展缓慢。页岩气开发中存在的环境风险、技术瓶颈和矿权重叠仅为制约因素而非决定性原因,关键在于我国页岩气特许权的制度逻辑导致的体制障碍。我国页岩气特许权在制度逻辑上体现为公权私权复合性、资源配置功能和相对于矿产资源所有权的附庸地位。预期推动页岩气产业的健康快速发展,必须在剖析页岩气特许权制度逻辑内生缺陷的基础上针对性地改进。The Chinese government is now actively implementing the industrial policy for shale gas, but the progress in the exploration and development of shale gas is fairly slow. The environmental risks, technical bottlenecks and mineral rights are the influencing factors but not the decisive factors in the exploitation of shale gas, and the key obstacle is the institutional barrier caused by the institutional logic of the shale gas concession in China, which find expression in the following aspects: it is an integration of the public rights and private rights, and the dependency of the function of resource allocation on the ownership of mineral resources. The future healthy development of the shale gas in- dustry relies on the improvement of the weaknesses of the institutional logic induced by our shale gas concession.
