外国投资者与非洲国家之间的投资争议分析——基于解决投资争端国际中心相关案例的考察

摘　　要：解决投资争端国际中心自成立至今50年来,受理了大量外国投资者与非洲国家间的投资争议。我们通过对这些案例的整理和分析可以看出,这些投资争议主要发生在接受外资较多,或易发生政治动荡的非洲国家,而提起此类投资争议的外国投资者主要来自英国、美国、法国、荷兰等传统上对非投资较多的西方国家。此类投资争议主要发生在石油、天然气、矿产、建筑业、交通运输业、生产、加工、运营等行业。此类投资争议解决程序中的仲裁员、调解员或临时委员会成员主要来自西方国家,其程序也主要是在西方国家内进行的。通过对比,中国投资者有利用该中心解决与非洲国家投资争议的现实必要性和实际可能性,但中国需要对中非双边投资条约的相关内容进行完善,尽量选择来自中非双方的仲裁员,选择在中非双方的地点进行仲裁,并尽量通过调解方式进行。从长远来看,中非双方可以考虑设立"中非投资争议解决中心"。In the past 50 years since its creation in 1966, ICSID has accepted a large number of investment disputes involving African states. It can be seen from the analysis of the investment dispute settlement between foreign investors and African states that such investment disputes mainly occurred in the African countries which received more foreign investment or were prone to political unrest; the investors that instituted such dispute procedures are mainly from Britain, the US, France, Netherlands, etc. , traditionally the Western countries that have more investments in Africa; these investment disputes mainly happened in such economic sectors as oil, gas, mining, construction, transportation, production, manufacturing and operation, etc. ; the arbitrators, conciliators and members of the ad hoc committees in such dispute settlement procedures are mainly from Western countries, and arbitration or conciliation mainly proceeded in Western countries. By comparison, it is necessary and possible for the Chinese investors to settle their investment disputes with the African countries through ICSID. However, the China -Africa BITs should be improved, the arbitrators or conciliators from China or African countries should be designated, the proceedings should be held in either China or Africa, and the dispute should be settled through amicable ways of negotiation, consultation, mediation, and conciliation as long as possible. In the long run, the establishment of a ＂China - Africa Center for the Settlement of Investment Dispute＂ （CACSID） may be taken into account in future.
