摘　　要：恐怖主义作为影响世界和平与发展的重要因素,很大程度上对国家治理构成挑战。法治化是国家治理现代化的必由之路,反恐怖主义也应当纳入法治轨道。对恐怖主义的防范和对尚未构成犯罪的恐怖活动进行惩处,需要一套权责分明、程序规范、监督有效、保障有力的行政执法体制。在行政执法机构方面,有关国家机关在各司其职的基础上,应当注意相互配合协作。在行政执法程序方面,国家机关应当遵守正当程序原则,注重保障行政相对人的程序权利。在行政执法中的公私合作方面,应当充分发挥多元主体在反恐怖主义工作中的作用,建立联动配合机制,同时政府应当对这些主体进行适度的监督。As a critical issue endangering peace and development of the world,terrorism challenges national governance.Rule of law is the only way to the modernization of national governance,and anti-terrorism should be brought to the road of rule of law.For the purpose of guarding against terrorism and of punishing terrorist activities which have not commit a crime,it is necessary to establish an administrative,law-enforcement system with well-defined power and responsibility,formal procedures,effective supervision and potent assurance.In terms of institution,all state organs should pay more attention to coordinat their roles.In the aspect of procedure,all states organs should comply with due procedure principles,paying attention to protecting the administrative counterparts.As for public-partnership,plural subjects on anti-terrorism should be fully exerted and linked coordination mechanism should be set up.At the same time the surveillance of the government on these subjects is essential.
