摘　　要：侵权行为与伤害责任认定是解决学校体育教育的矛盾纠纷,维护体育教育权、财产权和人身权,规范学校体育教育行为,遏制学校体育教学质量滑坡和学生体质下降的主要路径。借助文献资料法、个案分析法和逻辑分析法,在分析我国现行学校体育法的构成情况与立法缺陷,阐述学校体育教育中的侵权行为和伤害责任认定的基础上,从健全学校体育法律、法规体系,完善法律救济保障体系,拓宽学校体育侵权行为与伤害救济路径等几个方面提出了我国学校体育侵权行为与伤害责任法律救济的具体策略。The tort and damage responsibility identification is the main way of solving the dispute of school sports education,maintaining the education right,property right and personal right in PE,regularizing the behavior of school physical education and curbing the downturn of the quality of physical education and the students＇ physical deterioration. By means of literature consultation,case analysis and logic analysis,combined with basis of the analysis of the composition of the current school PE law and legislative defects,the analysis of the tort and damage responsibility identification of school physical education,this article puts forward that we should perfect our school sports laws and regulations system,perfect the system of legal remedy and broaden the path of the school sports tort and the damage remedy.
