摘 要:我国劳动法的立法目的是倾斜保护劳动者合法权益,并在此基础上建立和谐稳定的劳动关系。认定劳动关系是解决劳动法问题的逻辑起点,因此劳动关系的认定规则也应当遵从劳动法的立法目的。然而,我国现行劳动关系的认定规则却呈现出封闭、复杂的特征,其中退休返聘人员在工伤损害救济中所遭遇的劳动关系认定瓶颈是这一特征的重要例证。劳动关系认定规则的缺陷直接造成劳动关系认定的困难,进而影响劳动纠纷的解决。因此,根据劳动法的立法目的重新厘清劳动关系的含义,推进劳动关系的理性扩张,是对实践中存在的诸多因劳动关系认定困难而引发的各种争议的有效制度回应。Perfection of Chinese Labor Law legislation aimed at protecting labors' legitimate rights and interests,and on this basis to establish harmonious and stable labor relations. Identified labor relations is the logical starting point to solve labor problems,therefore labor relations rules should also comply with the legislative purpose of the labor code. However,the current labor relations rules appeared close,complex features,of which retired returning officer in injury relief identified bottlenecks encountered in labor relations is an important example. The defects of labor relations rules directly caused difficulties in the determination of labor relations,and settlement of labor dispute. Therefore,clarifying the meaning of labor relations,promoting the rational expansion of labor relations according to the objective of the Labor Law,are effective institutional responses in the controversies arising from difficulties in the determination of labor relations.
