用途管制下的土地指标交易法律构造

摘　　要：土地转用指标交易作为土地用途管制的配套制度,有利于实现平衡耕地保护、提高土地利用效率以及保障农民公平分享土地增值收益等多重目标。应当在科学地确定全国土地转用总量指标及初始分配的前提下,根据各地土地资源禀赋的差异,引入土地转用指标的市场交易机制,以提高土地的利用效率。政府应建立指标交易过程中的信息披露制度,监控指标落地区域的耕地质量和数量,强化事后的法律责任追究机制,以有效降低交易各方的交易费用。在完善土地复垦整理质量及质量的监督机制的前提下,逐步扩大指标交易范围至全国。The transaction of land conversion quota contributes to protecting cultivated land, increasing the efficiency of land usage, and guaranteeing the fair share for the peasants from the appreciation of the land value. On the premise of scientifically ascertaining the aggregate quota of land conversion and its initial distribution on a nationwide scale, we should introduce market mechanism. To lower the transaction costs for each party involved, the government should be responsible for the information disclosure, and the guarantee of the quality and quantity of the cultivated land in target areas, and also intensify the legal liability tracing system. Based on the improvement of the land consolidation and land reclamation, and the enhancement of their supervisory mechanism, the scope of the quota market should be gradually expanded to a nationwide level.
