国防资产法律概念探析——基于民事法律的视角

摘　　要：国防资产在国家和军队的现代化建设中扮演着非常重要的角色,但是,目前对于国防资产的研究较多地集中在经济学和行政管理学领域,由其界定的许多概念和制度并不能准确、严密地匹配相关法律制度。针对国防资产管理和运行现状,依托民法的基本原理,从国防资产的法律概念和法律属性两个方面对其加以审视,不仅可以使国防资产迅速进入民事法律保护的范畴,也为国防和军队建设领域改革夯实法理基础。Defense assets in the state and military modernization plays a very important role. Now more on the study of defense assets are in the field of economics and administration management. Many reaserches concepts and the system are not accurate and don＇t match the close related legal system. According the situation of national defense assets management and operation and relying on the basic principle of civil law,it can not only make the defense assets quickly into the category of civil law protection from the national defense assets of the two aspects of legal concept and legal attributes,but also strengthen the legal basis for the reform of national defense and army building field.
