摘　　要：当前世界主要空间大国对外层空间的军事利用已是不争的事实。因国际社会对"和平利用外层空间"的法律含义存在不同解读,在外空部署武器及进行反卫星试验的合法性问题随之出现。同时,太空战作为新型作战样式,在军事对抗中如何适用武装冲突法基本原则亦面临诸多挑战。这些均要求加强国际法律规制,进一步规范各国对外层空间的军事利用活动。Nowadays it＇s an indisputable fact that the world＇s major space powers are making military use of outer space. As different powers have different interpretations on the legal meaning of ‘peaceful use of outer space＇,Whether it＇s lawful or not to deploy weapons in outer space or to test anti- satellite weapons in outer space is still disputable. At the same time,as a new warfare style,space war will be confronted with a series of challenges on how to apply the fundamental principles of the law of armed conflict to military confrontations. All these require the international community to strengthen international legal regulations to guide military use of outer space.
