摘　　要：民事执行检察监督范围决定了执行检察监督权限度。从宏观层面来看,它是民事执行检察监督权行使的正当性基础;从微观角度而言,它是民事执行检察监督方式、程序运行和保障机制设定的前提。民事执行监督范围主要涵盖民事执行检察监督对象和监督事由两个方面。对民事执行检察监督对象的设定,应坚持以民事执行公权力监督为本体,而将执行当事人和案外人的违法行为排除于外;对民事执行监督事由的设定,应循着"一体两翼"模式结构,即以监督执行权异化为主体,沿着违法执行行为和消极不作为监督两个侧翼渐次展开。The procuratorial supervision scope of civil enforcement determines the supervision limit of the procuratorial supervision scope. From the macroscopic point of view,it is the legitimate basis of enforcing the rights of supervision; from the microscopic point of view,it is a prerequisite for the design of supervision methods,procedures and ensuring mechanism. The procuratorial supervision scope of civil enforcement mainly includes two aspects： the surveillanced objects and the surveillanced subjects. Regarding the surveillanced objects of procuratorial supervision system of civil enforcement,procuratorial supervision should be based on public power with illegal acts of the enforcement parties and people out of the case excluded. Regarding the surveillanced subjects,differentiated approaches of enforcing rights of supervision should be adopted,i. e. the supervision of illegal enforcing acts and that of negative nonfeasance.
