摘　　要：海上保险代位求偿权是法律赋予保险人的一项权利 ,只有符合法律规定的行使要件 ,保险人才可以以自己的名义行使该项权利。保险人行使代位求偿权的范围受其保险赔偿范围和第三人对被保险人应承担的损害赔偿范围的限制 。The right of subrogation for the insurer is given by law. The insurer can exercise this right under the name of his own as long as the exercising conditions are in line with the law. The right ranges from the indemnity paid by the insurer to the liability the third person should bear, from which the lower shall be chosen.
