美国金融防火墙制度的演化与反思

摘　　要：梳理和分析20世纪30年代以来美国的金融防火墙制度建设所经历的严格管制到比较宽松再到加强监管的三个阶段,总结各阶段美国金融防火墙制度的内容、特点与作用。美国金融防火墙制度的优点在于它能随金融环境的变化而进行相应调整,从而更有效地提高金融业效率与竞争力,控制金融业的风险;美国金融防火墙制度建设的不足之处在于其是政府与金融集团博弈与妥协的结果,且在金融集团追求利益最大化的目标下缺乏足够的前瞻性,无法有效监管金融创新中的风险。借鉴美国金融防火墙制度的经验与不足,对我国金融防火墙制度建设提出了八大建议。Sorting and analyzing the American financial fircwall system since 1930s＇ , and from the stage of strict controlling to loo- sing regulation to strengthening the supervision finally and then summarizing the contents, characteristics and functions of the financial firewall system, this paper considers that the strengths of the American financial firewall system is of flexibility on the change of financial environment so that it can improve the efficiency and raise the competitiveness of the financial sector effectively and control the financial risk; the deficiency of the American financial fircwall system is that it is a result of concession of competition by government and financial industry and due to the lack of enough perceptive- ness, the financial groups are not able to supervise the risk in financial innovation effectively. Based on the strengths and deficiency of the American financial firewall system, the paper finally proposes advices from eight aspects on the fi- nancial firewall system in our country.
