摘 要:立法者将危险驾驶行为入刑,希望透过严密刑事法网、加大惩罚力度的方式严管严控危险驾驶行为,回应社会人民群众的普遍关切。然而,治理危险驾驶现象,并没有简单的像立法者所预期的那样,将危险驾驶行为犯罪化,一味重罚便收到奇效。危驾入刑效果欠佳,重刑威慑作用有限。正是公安机关通过增加执法投入、健全执法依据、加大执法宣传的方式严格执法,使查处危险驾驶行为成为常态,才取得治理危险驾驶现象的显著成效。在治理危险驾驶行为的后续进程中,应当继续加强执法力度,及时查处危险驾驶行为。Criminal legislation criminalizes the dangerous driving behavior, hoping through strict criminal net and increasing penalties to strictly manage and control dangerous driving, in response to widespread concern about social masses. However, governing dangerous, which violates the legislator's expectations that criminalizes the dangerous driving and blindly penalties can receive mi- raculous. The effect of criminalization and heavy deterrent are limited, it's the increase investment of law enforcement, improve basic of law enforcement and increase awareness of law enforcement that enable dealt with dangerous driving become the norm in order to obtain the remarkable results. During the follow-up process of governance, we should continue to strengthen enforcement and timely investigate the dangerous driving.
