依法治校背景下现代高校章程法治化建设:困境、归因及突破——基于福建省部分高校章程文本的分析与思考

摘　　要：随着"依法治校"理念不断深入,现代高校法治治理日益重要且已被提上议程,而高校章程是现代高校法治治理的重要载体,因此高校章程自身法治化建设凸显重要性和关键性。尽管福建省部分高校已经创制了正式章程或章程(草案),但不论是在高等教育管理实践中,还是在维护校内师生主体合法权益方面,其发挥作用甚微。基于此,文章通过对福建省部分高校章程文本的分析,从效力位阶、实体内容、程序操作以及监督实施层面找到问题所在,针对这些问题以及结合它们产生的原因,最终提出了现代高校章程法治化建设困境的突破路径。With the ideal of ＂managing the university by law＂ deepening, the govern of the modern u- niversities by law turns to be more and more important, and has been put on the agenda. University charter is an important carrier of the governing of the modern universities by law, therefore, the legal construction of university charter becomes important and crucial. Although formal charters or charter drafts are made by some universities in Fujian Province, they exert limited influence in the manage- ment practice of the higher education and in protecting the legitimate rights and interests of teachers and students. Based on the analysis of some universities＇ charter text, the article finds the problems from the perspectives of the effectiveness of rank, the entity content, program operation and supervi- sing implementation. Finally, breakthrough path is proposed to help universities to leave the predica- ments of the legal construction of the modern university charters.
