我国体育领域肖像权法律问题研究——基于国外相关立法的借鉴

摘　　要：与法律体系较为完备的国家相比,我国体育领域肖像权保护在法律层面上不同程度地存在保护范围狭窄、主体规定不明、合理使用范围缺乏法律依据等问题。借鉴美国、德国、法国、荷兰等国相关立法及司法解释,指出我国体育肖像权的保护范围应进一步拓展;体育领域肖像主体权应进一步明晰;明确肖像权的合理使用范围;适当补充侵权构成要件;不断完善及时有效的赔偿机制。Compared with countries with sound law system,the portrait right protection in the sports field in China has the problems of narrow protection scope,unclear subject regulation and lack of law regulation in law application scope.The paper compares and discusses the legislation and judicial interpretation in U.S.,Germany,France and Netherlands.The paper proposes to expand the sports portrait right protection range in China,clarify the sports portrait subject right,define the reasonable range of portrait right,make reasonable compliment of infringement components and improve the effective compensation mechanism.
