摘　　要：土地承包经营权入股涉及的法律问题较为广泛,但相关法学理论研究和具体制度的构建尚在起步阶段。文章通过对农村土地承包经营权入股公司的内涵界定,从法律制度完善的角度探讨土地承包经营权入股公司的法律性质及其存在的现实困境,并对进一步完善农村土地承包经营权入股公司法律制度提出了建议。Although the legal issues involving buying shares with the land contract management right arewell-known, the relevant theoretical study and the building of specific systems are still at an initial stage. In this paper, in view of the improvement of the legal system, the legal character and practical difficulties of buying shares of companies with the land contract management right are discussed based on the definition of buying shares of companies with the rural land contract management right. On this basis, some relevant countermeasures and suggestions are also put forward.
