勤勉检索:数字技术环境中图书馆利用孤儿作品的前置程序──基于国际社会立法比较的思考

摘　　要："勤勉检索"是图书馆利用孤儿作品的法定前置程序,其意义在于认定和授权使用孤儿作品、享有责任限制与豁免权、维系版权利益关系的平衡。影响勤勉检索制度立法的主要因素包括立法传统与基础、检索成本、图书馆的版权角色、版权信息管理系统建设状况等。我国对图书馆利用孤儿作品勤勉检索制度的立法可以从不同国家和地区的相关法律及理论中得到启示与借鉴,基本架构包括立法的性质、检索标准、合理补偿和收费、检索对象与效力等。＂Retrieving diligence＂ is the use of orphan works Library statutory pre-procedure, its significance lies in the identification and authorizing the use of orphan works, enjoy liability limitations and immunities, to maintain the balance of copyright interests. The main factors affecting the legislation diligent retrieval system includes a legislative tradition and foundation, retrieval costs, the role of libraries in copyright, copyright information management system construction status. Our Library Retrieval System diligent use of orphan works legislation can draw inspiration and learn from the relevant laws and theories from different countries and regions, the basic architecture including the nature of legislation, retrieval, reasonable compensation and fees, retrieve objects with an equal effectiveness.
