摘 要:随着网络技术日新月异,信用卡从以前的实体卡逐渐发展为虚拟卡、数字卡,并且通常情况下与手机里的支付宝、微信支付等软件绑定使用。在近几年的司法实践中,拾到手机或者盗窃手机、抢夺手机等犯罪行为,也常常伴随着利用手机客户端对绑定信用卡进行处分和使用。法条第196条第三款和两高《信用卡管理解释》第五条第三款第(四)项存在逻辑上的冲突,对冒用型信用卡诈骗罪的"冒用"本质尚未进行合理的解释。在网络金融的大背景下,冒用型信用卡诈骗罪的性质需要重新界定。无论是学理还是实践,研究冒用型信用卡诈骗罪,我们都应当解剖冒用型信用卡诈骗罪的行为模型,从获取渠道、冒用的方式以及诈骗的手段三个方面进行分析。With the rapid change of network technology, the credit card has gradually developed from the previous physical card into virtual or digital one, and is often used with Alipay, Weehat or other payment software installed in the mobile phone. In recent years' judicial practice, handling and using credit cards bound to mobile phone clients is always taking place with crimes of picking up, stealing or snatching mobile phones. There is logical conflict between Section 3, Article 196 of Criminal Law and Item 4, Section 3, Article 5 in the judicial interpretation on credit card management released by the Supreme People's Court and the Supreme People's Procuratorate, and the property of crime of credit cards fraud needs to be redefined in the setting of financial network. The behavior model of crime of credit cards fraud should be dissected in both theory and practice fields. We should analyze crime of credit cards fraud via three aspects: fraud behavior, the affecting object and the fraud object.
