摘  要:将瑕疵登记所公示的无权处分,扩大到与登记公信力无关的冒名处分,是不动产善意取得被曲解的症结。其原因在于否认物权意思表示,将属于交易双方私法自治行为的物权变动登记,割裂为单纯的政府公权力确认,以至于出现只要冒名处分人将房产进行转移登记,善意取得绿灯大开的局面。应当看到,冒名处分不存在基于登记公信力表征的处分权,无法达成转移所有权的意思合致,没有物权意思合致支持的登记是虚假可撤销的,买受人也无法善意取得所有权。The core reason why bona fide acquisition of real property is misinterpreted is that the unauthorized disposal demonstrated by the defect registration is expanded to the false impersonation disposition which has nothing to do with the registration credibility. The problem is that treat the alternating registration as single public power operation,rather than the agreement of property right which belongs to civil law autonomous behavior of trading partners. The adverse consequence is that bona fide acquisition will occur as long as the false impersonation disposition person makes transfer registration. We should realize that the false impersonation disposition doesn't have the disposition right based on characterization of real estate registration's confidence. Trading partners cannot reach the agreement for transferring ownership. Without the agreement of property right the registration is false and revocable.And the purchaser cannot get ownership with the bona fide gain system.
