论台湾地区民事裁判在大陆认可与执行制度的完善——兼评2015年最高人民法院新司法解释

摘　　要：大陆法院对台湾地区民事裁判的认可和执行持支持态度。《最高人民法院关于认可和执行台湾地区法院民事判决的规定》更加系统、清晰地规定了台湾地区民事裁判的认可和执行问题。该司法解释增加了人民法院管辖的连接点,放宽了案件的受理条件,区分了不同的申请期限,增加了救济的途径,扩大了认可和执行台湾地区民事裁判的范围等。司法实践中,大陆法院需要就专属管辖权进行协商和明确公共政策的适用范围。People＇s courts are in favor of recognizing and enforcing the civil judgments of courts of the Taiwan Region. The Provisions of the Supreme People＇s Court on Recognition and Enforcement of the Civil Judgments of Courts of the Taiwan Region which was issued and came into force on July 1,2015,regulates the legal issues relating to the recognition and enforcement of the civil judgments of courts of the Taiwan Region in judicial practice more systematically and clearly. This judicial interpretation increases the number of contacting points choosing the proper peoples＇ courts,simplifies the requirements of acceptance of the application,distinguishes the different periods for application,provides ways for relief,and increases the types of civil judgments for recognition and enforcement,and also. However,in judicial practice,it is of great necessity for peoples＇ court to negotiate with the competent authorities of Taiwan Region about the exclusive jurisdiction and specify the contents of the public policy.
