中国分批次逐步废止死刑之构想——以《刑法修正案(九)》废止死刑实践为切入点

摘　　要：《刑法修正案(九)》启动第二次死刑废止具有承上启下的历史意义。本次修法废止了9个罪名的死刑,从宏观上看符合时代趋势和基本顺序,单一考察也基本遵循废止死刑的主流思路,但若将其纳入配置死刑的"罪名大军"中考察,合理性和协调性尚存探讨空间。从长远看,每次修法时方拟定若干死刑罪名进行废止欠缺前瞻考虑和整体规划。结合我国实际,可将废止死刑罪名的基本标准确定为"是否暴力、是否致命或致其他极度严重后果",并结合实践中配置死刑的犯罪是否较多适用死刑、废止死刑会否带来较大负面影响等因素,在稳妥推进、多量少次、统筹协调等原则指导下,全面梳理我国死刑罪名并分门别类,按照废止死刑罪名的基本标准拟分三批次逐步废止全部死刑罪名。The second death penalty abolishment initiated by Amendment to Criminal Law（Nine） forms a connecting link between the preceding and the following.The amendment abolished death penalty of nine charges,conforming to tendency of times and basic sequence from macroscopic view,we inspect them one by one according to the mainstream thought of death penalty abolishment.However,if we put them into the whole charges of death penalty,we still need to have a discussion over its rationality and harmony.In the long run,several charges of death penalty are usually worked out before amending of the law,which results in the absence of overall planning and foresight consideration.Based on our actual conditions,the basic criteria of death penalty abolishment can be defined as ＂whether violence is used,whether deadly or other extremely serious consequence is brought about＂.In addition,taking into consideration some elements such as scope of application of death penalty charges and negative influence of death penalty abolishment,we shall understand and classify China＇s all charges of death penalty to abolish them in three times according to the basic criteria of abolishment of death penalty charges,under the guidance of principles of carry forward in a steady,coordinated way.
