明代申明亭在解决基层纠纷中的作用及当代启示

摘　　要：明代申明亭制度是明初朱元璋按照儒家乡里教化的思想创置的民间基层调解制度。这一制度通过在民间设立里老人这一独具特色的角色,宣朝廷行法令、旌善扬恶以及按照规定程序进行基层纠纷调解,以求达到儒家思想中的无讼社会。尽管在六百多年后的当今社会,申明亭早已不适应我国的现代法治建设环境,但该制度所体现出来的普及法令、注重道德教化和通过民间调解解决基层纠纷的思路仍然有其可借鉴之处。Shenmingting system in Ming Dynasty, a system that had been set up in the early Ming Dynasty in accordance with the thought of Confucian country cultivation by Zhu Yuanzhang,was a grassroots mediation system in the folk. In order to pursue a no-litigation society of Confucianism,it established a unique role＇the Old Man in the folk, who announced and carried out the court decrees, praised the good and punished the evil, and mediated the grassroots disputes according to the prescribed procedures. Although Shenmingting system does not fit the modem legal system of our country in today＇s society-over 600 ye.ars later than Ming Dynasty, the thinking that popularizes the laws, lays emphasis on the moralization and solves the grassroots disputes in the folk the system reveals is still highly valued.
