摘　　要：农村征地拆迁实践中所呈现的,舆论和媒体普遍将农民作为"弱势群体"的定位与现实中频频出现的大量因征地拆迁而一夜脱贫甚至暴富的"致富群体"并存的"怪象",引发对征地拆迁补偿公平性的思考。这种公平包含两个层面:一是用地方与被征地方之间的补偿公平;二是受国家土地用途管制和分区控制而导致的被征地拆迁地区与其他未被征地拆迁地区之间的公平。在中国目前土地公有制的制度框架约束前提下,农村集体经济组织作为集体土地的所有者代表,理应作为土地市场的供给者,享有土地交易的收益,并对征地拆迁补偿款在同一社区内按照社区制订的规则进行调节,以保障同一社区内征地拆迁户与未被征地拆迁户之间的公平;因土地用途管制和分区控制而导致的不同地区集体土地利用收益差异,应由国家通过建立征地补偿转移支付制度以维护社会的公平。T here are some strange phenom ena coexisting in the process of rural landappropriation that public opinion and media widely position the farm ers as a vulnerable groupsand the reality of a large num ber of “ rich com m unity” night out of poverty and even get rich bythe requisition, thus it causes the consideration of land expropriation com pensation fairness.T his fairness includes two asp ects： the first is the com pensation fairness betw een the landdem ander and the land expropriation ; the second is the fairness betw een the region w here hasbeen dem olished and relocated w ith other has not been dem olished and relocated caused by thestate land use control and partition. It is concluded that under the prem ise of land public ownership institutional framework in China at present, the rural collective economic organizations as arepresentative of the collective land ow ners should be entitled to the rights and interests in theland m arket transaction as a land suppler, and adjusts the requisition com pensation inaccordance w ith the regulations set by the com m unity w ithin the sam e com m unity,so that it canensure the justice betw een the households w hich land is relocated w ith those are not relocatedw ithin the sam e com m unity. A lso the differences of land use income of rural collective indifferent areas caused by the state land use control and partition should establish the transferpaym ents of land expropriation com pensation system by the state to safeguard social fairness.
