摘 要:重大决策社会稳定风险评估是近年来我国社会治理体制和维稳机制创新的重要成果之一,其机制的良性运转和功能的全面发挥都同其法治化建设的程度密切相关。然而,在当前"深入推进依法行政,加快建设法治政府"的背景下,运行十年有余的"稳评"遭遇到了法律依据不充分等多方面的问题,而能够有效解决上述问题的优选方案是推动"稳评"的法治化建设。本文基于相关政策文件和地方实践,对"稳评"法治化建设的理由、实践和路径等基本问题进行了深入研究,结论是"稳评"法治化建设的更高目标是立法基础上的有法必依,这有赖于相关"组织保障和落实机制"的建设。Social stability risk evaluation of major policy decisions(wenping) is an important innovation achievement of China' s social governance system and stability maintenance in recent years, and its legalization building has a great impact on the mechanism' s benign operation. However, under the circumstances of "thoroughly advance the administration of government based on the law and accelerate efforts to build a rule of law government", wenping that running more than ten years encounters several problems such as the legal basis is not sufficient. Based on the relevant policy documents and local practices, this paper makes a comprehensive research on the legalization building of wenping from three dimensions : reasons, practices and paths. It concluded that, the higher goal of the legalization building is the laws are strictly observed, which depends on the building of organizational guarantee and implementation mechanisms.
