基于农民认知的土地整理监管共治式建构

摘　　要：强化农民参与以构建共治式土地整理监管是改善相关政府治理活动的必要举措,农民认知程度的高低往往决定了其参与监管所需参与能力的水平。可通过对样本地区农民相关认知状况进行访谈式问卷调查,从便于农民参与监管的目标导向出发,来研究监管主体、监管责任主体、农民参与监管相关法律规范可能的设定途径,进而有针对性地厘清我国土地整理监管制度可行的构建方向。应基于农民对土地整理监管主体、监管责任主体和参与监管的认知状况,分别设定专门监管和多方参与监管规范、阶段性监管中的差异化责任主体规范、参与模式和参与保障规范。Strengthening farmers＇ participation so as to construct the co-governance＇s land consolidation supervision is the necessary measures of improving related government governance activities.The degree of farmers＇ cognitive status often determines the level of farmers＇ participation ability needed to participate in supervision.We can implement the questionnaire survey in type of interview of farmers＇ relevant cognitive status in the sample area;so as to find the possible setting ways of relevant regulatory subject norms,regulatory responsibility subject norms and the norms of farmers＇ participation in supervision.The research is starting from the goal orientation for helping farmers＇ participation in supervision,and then to clarify the feasible construction paths of China＇s land consolidation supervision system targetedly.We should set the norms of special supervision and multi-participation in supervision,the norms of differentiated responsibility subject in phased supervision,the norms of participation model and participation safeguard;the respective setting is based on the farmers＇ cognitive status of land consolidation regulatory subject,land consolidation regulatory responsibility subject and participation in land consolidation supervision.
