摘　　要：法律评价是司法机关适用法律的实践活动。法院行使审判权和检察院行使检察监督权是法律评价的两种类型。对法院行使审判权和检察院行使检察监督权的文化层面的探讨,涉及到对法院文化和检察文化的研究。法院文化和检察文化是法律评价中的两种基本文化形态。研究法院文化建设、检察文化建设与当前司法改革的关联性,有助于推进司法机关行使法律评价职权的社会文化环境建设,对研究中国的司法改革具有特殊的重要意义。Legal evaluation is the practice activities in to which judicial authority apply law.The people′s courts exercising jurisdiction and the people′s prosecutors exercising right of prosecution supervision are two basic types of law evaluation.The discussion on the culture level of the people′s courts exercising jurisdiction in and the people′s prosecutors exercising right of prosecution supervision in refers to the research of the court culture and the prosecutorial culture.The court culture and the prosecutorial culture are two basic types of culture in law evaluation. Discussing the interrelation between the court culture construction,the prosecutorial culture construction and the judicial reform is of special importance to study on Chinese judicial reform,which promotes the construction of social and cultural environment of the judicial authority exercising the legal evaluation.
