摘　　要：村级集体财产的治理是村民自治的核心和根本,治理好坏直接决定着村民自治的成败。近30年来,村民自治制度的实施效果并不理想,原因在于其对村级集体财产的治理并不成功,根源在于农村集体产权的模糊。我国村民自治的经济基础不仅是一般意义上的集体产权,更关键的还有国家对集体产权制度的具体建构与保障。农村集体产权制度改革的意义,就是通过一系列的"确权""分权""赋权""活权",在坚持国家基本经济制度的基础上,赋予农村集体经济组织成员更多财产权利,实现产权的多层明析和法制化,建立起可落地的集体产权有效治理的制度,从根本上厘清制约村民自治施行的"国家—村民自治体"和"自治组织—村民"两大关系,从而为村民自治制度和乡村治理体系的现代化奠定切实的基础性条件。The governance of the village collective property is the core and foundation for villagers＇ autonomy, which directly deter- mines the success or failure of villagers＇ autonomy. In the past 30 years, the governance of rural collective property rights by the villag- ers＇ autonomous system has not been successful, which rooted in vague of the rural collective property rights. The economic base of our rural villagers＇ autonomy not only contains the collective property rights, but also contains the country＇s reasonable construction and protection of legitimate collective property rights system. The significance of rural collective property rights system reform is that through a series of“do the right” , “decentralization” , “empowerment”and “right to live” , and adhere to the basic economic system, giving farmers more property rights, realizing the property of multi-layer clear and legalization, establishing an effective collective property rights governance system, and also clarifying two relationships of “National-Villages＇ Autonomy” and “Autonomous organizations-Vil- lagers” , thus the basis will be laid for the modernization of the rural governance system and villagers＇ autonomy system.
