摘　　要：从群体行为心理学的角度来说,人类厌恶不公平待遇。群际实力、地位的不平等会导致受到不公平待遇方的群体焦虑,进而产生推动一致行动的心理。历史上很多经济立法产生于民众厌恶"不平等、不公正"心理的集中爆发。世界上众多开创性的经济立法都证明经济法并非产生于立法精英们对市场的考虑,而是产生于民众高涨的愤怒情绪的"宣泄"。心理学显示,愤怒的立法容易低估风险,经济法在立法时由于法律实施效果"概率"的缺失,其立法的手段和目的之间有可能脱节。因此,经济立法相比民法来说,应具有超前性,必须保持克制和理性。Human beings are not completely driven by economic principle, and sometimes unfair treatment will lead to non-cooperative behaviors. From the perspective of psychology of group behavior, human hate unequal treatment. Intergroup strength and status inequality will cause to be subjected to unfair treatment group anxiety, thereby promote the concerted action of psychological. In history, a lot of economic legislation produced in concentrated outbreak of public ＂inequality and injustice＂ psychological. Economic Law is the outbreak of mental focus of ＂unequal and unjust aversion ＂in the public. Economic legislation is not an advanced social structure construction by elites. Therefore, the means of economic legislation may also be out of line with the purpose, so legislators must exercise restraint and rationality.
