中外数字信息资源保存相关法律制度之比较

摘　　要：数字信息资源保存是为了保存数字时代人类的记忆,保证数字信息资源可持续利用而采取的必要措施;法律制度建设是数字信息资源保存得以实现的根本保证。和国外发达国家相比,中国数字信息资源保存制度在立法主体、法律类型、缴存义务人、缴存客体等方面都存在着一些差距。建议我国学习发达国家立法及实施经验,加快数字信息资源的立法进程,提高法律效阶,统一法律制度,从而使民族文化遗产能够完整保存、世代传承。Digital information resource preservation is to preserve the memory of the digital age, it is the necessary measures to ensure the sustainable use of digital information resources; The construction of legal system is the fimdamental guarantee for the preservation of digital information resources. But compared with foreign countries there is very great disparity in the legislative subject, the legal type, the deposit obligations, the deposit of the object and other aspects in China. It is suggested that we learn the legislation and practice of the developed countries, Speed up the legislative process of digital information resources, improve the legal effect, and unify the legal system, so that the national cultural heritage can be preserved and inherited from generation to generation.
