摘 要:目前,我国部分地方政府正试图引进、探索的"吹哨人"制度具有丰富的内涵,着眼于"内部人"并通过奖励、保护机制使"内部人"将组织内部潜藏的违法信息向外界传递,打破了政府与组织之间信息不对称的格局。在行政法学视野中,"吹哨人"制度是我国政府加强对市场监管的"技术手段",也是促成政府与私人合作的"粘合剂",更是激活公民权利、鼓励公众维护社会道义的"驱动装置"。我国引进"吹哨人"制度,根本上是治理思路的革新,即通过多元、合作的方式来实现社会治理水平的整体跃迁。At present ,some local governments are trying to introduce and explore the Whistle‐blower System in China .There are many kinds of connotations in that system .It focuses on the insiders and makes them transmit the internal hidden illegal information of organizations to the government through incentive and protection mechanism to break the pattern of information asymmetry between the government and the organization .From the perspective of administrative law ,the Whistle‐blower System is not only viewed as a technical method to strengthen the government's supervision over the market , a connection that contributes to the collaboration between the government and private organization ,but also is referred to a driving force of the activation of the civil rights and the enhancement of the public to maintain social morality . Essentially ,the introduction of the Whistle‐blower System means the concept innovation of social governance ,that is ,through multiple and cooperative way to achieve the overall transition of social governance .
