“一带一路”视阈下中国—东盟货币互换法律机制研究

摘　　要：中国—东盟货币互换法律机制是指对中国与东盟各国货币互换的制度性安排,包括规则、程序及其组织机构的总称。目前中国—东盟货币互换机制以双边协议为主,《清迈倡议》多边化协议是区域性的货币互换的制度安排。针对现有的货币互换的问题,在"一带一路"的思路下,应当明晰中国—东盟货币互换的近期、中期、远期目标,增加合作机制的灵活性和务实性。在中国东盟金融合作中,应当完善货币互换双边协议的内容和约束力,弥补区域性货币互换机制的缺陷,建立双边、区域、多边的制度联动。Legal mechanism of currency swap in China and ASEAN includes all the rules,procedure and institutional frameworks on the currency swap in the forms of regional arrangements or the bilateral agreements.The swaps between China and ASEAN countries in present are performed as bilateral agreements in the most.The only regional arrangement on swap is CMIM.BR Initiative clarify the development direction of the swap between China and ASEAN.It is important to perfect the bilateral swap agreements and build a regional swap legal system.
