民生检察热线权利救济功能的阻滞因素与现实进路

摘　　要：当前,社会公民普遍存在维权意识重于守法意识的观念错位现象,利用民生检察热线反复举报控告、甚至恶意举报控告等滥用权利现象时有发生,不仅使有限的司法资源被恶意挤占,更影响和制约了民生检察热线权利救济功能的正常发挥。究其原因,主要是由于公民维权意识重于守法意识,对司法机关缺乏信任,对反复、恶意举报缺乏有效制约,外部协调机制不健全,辖外事项处理难度大等原因造成。建议采取强化普法宣教,引导民众正确利用民生检察热线,建立健全热线事项协作处理机制,引入社会冲突终结机制等方式加以应对。At present, there is dislocation phenomenon between rights protection consciousness of ordinary citizens and the idea of law-abiding consciousness. Cases occur from time to time in reporting complaints and even malicious complaints by using the prosecution of the People＇s Livelihood Hotline, which turns out to be malicious use of the limited judicial resources, and even more seriously, to restrict the normal remedy functions of the People＇s Livelihood Hotline. The reasons to these problems are mainly the lack of consciousness in the civil fights, lack of law-abiding consciousness, lack of trust in the judicial organs, and lack of effective restrictions. They also occur because there are not enough sound mechanism in dealing with malicious violations and external coordination. It is very difficult to solve the issues concerning foreign affairs too. Thus suggestions and measures are raised here to strengthen the franco-prussian propaganda and education, to guide people to use the People＇s Livelihood Procuratorial Hotline correctly, to establish and perfect the hotline collaboration mechanism, to introduce mechanism in solving social conflicts, and so on.
