摘　　要：农业政策与农业法都是保障和促进农业发展的重要手段。二者是不同概念却存在密切联系,正确处理二者关系对于"法治三农"的构建十分重要。然二者关系在守旧模式下存在效力逻辑上的模糊和规范功能上的低效问题。强化农业法对农业经济活动的规范作用,规范农业政策制定程序及加强监督机制的建设应是提升二者治理能力的可能进路。Both agricultural policies and agricultural laws are the significant measures to ensure and promote the agricultural development.They are different concepts but closely related.Dealing with their relationship appropriately is important to legitimizie rural areas,peasants and agriculture.However,the relation between them existing in the traditional mode had two problems：the vague effectiveness logic and inefficient regulating function.In order to enhance the governance capacity of agricultural policies and agricultural laws,the paper suggested to consolidate the regulating function of agricultural laws for agricultural economic activities,and specify the formulation process of agricultural policies and strengthening the construction of supervision mechanism.
