摘　　要：农业收入减少、农业人口老龄化和农村过疏化,促使日本决定将农业发展为第六产业。第六产业是基于第一产业、第二产业和第三产业的融合,通过对农村的农产品、土地、水和其他资源有效利用,创造新的附加值。日本农林水产省制定促进第六产业基本方针,并由农业者制订第六产业计划。促进第六产业的具体措施包括:人才培养、资金支持、研究开发和成果利用。日本第六产业法律制度研究对中国农村一二三产业融合发展的启示在于,推进农村一二三产业融合立法、明确新型农业经营主体的核心地位、确立农业的主导地位、多种渠道提供资金支持、健全人才培养机制、重视农业科技创新和成果利用的作用。The backgrounds of developing agriculture into the Sixth Industry in Japan include a decrease of agricultural income,aging of agricultural population and rural depopulation.Based on integration among primary industry,secondary industry and tertiary industry,the Sixth Industry creates new added-value through effective use of agricultural products,land,water and other resources in rural area.The Japanese Ministry of Agriculture,Forestry and Fisheries released basic policies of the Sixth Industry promotion,and farmers set plans of the Sixth Industry.The specific measures of the Sixth Industry promotion include talent development,financial support,research and the use of achievements.The research on Japanese legal system of the Sixth Industry is an important reference to rural integration among primary industry,secondary industry and tertiary industry in China,which should push legislation of rural integration among primary industry,secondary industry and tertiary industry,clarify the central role of new agricultural management entities,establish leading role of agriculture,provide financial support by various channels,improve system of talent development,attach importance to role of the innovation of agricultural science and technology and the use of achievements.
