摘　　要：鉴于医疗器械作为一种特殊医疗产品,在侵权责任上和药品侵权责任存在巨大差异,以王跃进诉鹤壁市人民医院为例,具体阐述二者差异,并分情况讨论植入类医疗器械存在警示缺陷时,医院、植入类医疗器械生产商的责任承担情况。As a special medical product, there is a huge difference of tort responsibility between the medical products and medicine. This paper takes the case of Wang Yuejin vs. People＇s Hospital of Hebei city as an example, elaborates the differences, and discusses the legal responsibilities that should be assumed by hospitals and implanted medical equipment manufacturers respectively when the warning defects appear.
