美国心理学专家进入司法精神鉴定领域对我国的启示

摘　　要：具有心理学背景的鉴定人之所以具备专家证人资格的原因在于不同学科间鉴定方法和视角上的差异,心理学专家具备心理障碍诊断的能力,有较高的鉴定信度和效度。司法精神鉴定工作本身涉及多学科、多领域的内容,因此多学科参与下的司法精神鉴定对我国当前的司法鉴定制度有一定的启发意义,未来我国的心理学专家能否在法庭上得到认可并赢得尊重需要结合我国的法律制度,探索更深层的制度性改革措施推进我国司法制度的健康发展。Psychological experts with professional background can be qualified expert witnesses due to their possessed ability in diagnosing mental disorder with higher reliability and validity of identification,as well as applying identification methods with various viewing angles to judicial psychiatric expertise.As judicial psychiatric expertise involves multidisciplinary fields,the participation of multidisciplinary experts in America has enlightenment to China＇s current judicial psychiatric expertise system.In the future,whether Chinese psychological experts can be recognized and win respect in court depends on the efforts to combine China＇s law system and explore system reform measures in depth to promote healthy development of China＇s judicial system..
