摘　　要：《信息网络传播权保护条例》(以下简称《条例》)在我国法律制度中为图书馆合理使用数字版权开了立法的先河。十年来,《条例》对图书馆的立法意义、缺陷以及创新等问题引起学术界的关注、研究与争议,焦点集中在合理使用制度的价值取向、立法技术、适格主体、属性定位、标准的定性和定量、收费与合理使用适用等方面。国内学术界对图书馆合理使用制度的探讨呈现出敏锐性、开放性、应用性和广泛性等特征,但是对行业性版权政策、纠纷诉讼案件以及立法进路多元化的研究较为薄弱。Regulations on the Protection of the Right to Network Dissemination of Information （hereinafter referred to as the Regulations） sets a precedent for library legislation of fair use in digital copyright in Chinese legal system. For decades, the legislative significance, defects and innovation of the Regulations have aroused great concern in library academic community, focusing on the values, legislative technique, eligible subjects, attribute positioning, qualitative and quantitative standards, charges, application of fair use and so on. The discussion on library fair use system is of sensitivity, openness, applicability and pervasiveness. However, less research is conducted on industry copyright policy, litigation cases of disputes and the diversification of legislation.
