法官职业的道德义务和美德

摘　　要：司法伦理是一门探讨法官道德责任义务的学科。法官只有具备了美德才具有道德价值。司法伦理掌握司法本身的道德性及其理性价值、伦理关系和伦理评价,是对司法、文化与法官间的协作以及一系列共同、基本的伦理价值、规范及态度之基础的寻求和建构。司法公正既意味着维护公义也意味着"善"。对于法官的道德要求,就其形式而言,都试图将法官塑造成为比现状更加完美。司法的本体世界就是一个道德世界,是法官所从属的真正在职业精神上自觉的世界。法官生活的道德标准惟有借助于司法伦理才能形成,司法伦理的目的是为法官自身建构一个与其职业相关联的秩序。Judicial ethics is a subject which focus on discussing the judges＇ moral responsibilities. The judges only have the virtue can be taken as possessing the moral value. The judicial ethics contains the morality,the rational value,the ethical relationships and the ethical evaluation of the judiciary itself. The judicial ethics is to seek and to construct the cooperation between judiciary,culture and the judges. Also,the judicial ethics can pursue and construct a foundation of a series of common and basic ethical value,regulation and attitudes. The justice in judiciary means not only maintain the righteousness,but also the ＂goodness＂. What we ask for the judges＇ morality formally is to make the judges more perfect than what it is right now. The judicial noumenal world itself is a moral world,which is a self- conscious world in professional spirit that the judges truly belong. The moral standard of judges＇ lives can be formed only by the effectuation of judicial ethics. The judicial ethics targets on constructing career- related orders for judges.
